Picture Perfect “Pearl” Search

RULES AND REGULATIONS

1. It is the intent of this search contest to find women 21 and over, who resemble the image of the woman we call “Pearl” found on many of the Imagine Wine, LLC wine labels.  The contestants will make every attempt to present themselves for the search contest dressed in 1940”s costume, that they provide, and made up in a manner to resemble “Pearl” in facial features, hair and body type.  It is in the sole judgment of the representatives of Imagine Wine, LLC that the contestant does resemble “Pearl” and is dressed and made up appropriately and qualifies as a contestant.
2. The contestant must agree to abide by all rules as set forth here or changed from time to time by the organizer.
3. The contestant must be 21 years or older and agree to produce a valid ID with picture and birth date.
4. Application for the Imagine Picture Perfect “Pearl” search contest may be made on line at www.imaginewine.com or will be accepted at any Imagine Picture Perfect “Pearl” event no later than 15 minutes prior to the scheduled beginning of the event.
5. Imagine Wine, LLC and their participating retailers for any event are not responsible for any delays or non-receipt of applications on any account and for any reason whatsoever.
6. The contestant may enter online or at an event as many times as she wishes as long as she meets the requirements of the search contest Rules and Regulations. If rejected for any reason at any event the contestant may not participate in any future event.
7. All Prizes are subject to deduction of tax at source and all other taxes, as required by law.
8. Imagine Wine, LLC is not responsible for any loss or physical injury that occurs to the contestant on account of their participation in the search contest. The contestant will participate at her own risk and will have no claim against Imagine Wine, LLC in any regard.
9. Incorrect information will result in disqualification, whether discovered prior to, during, or after the event.
10. Schedule of events are subject to change at the discretion of Imagine Wine, LLC and or their participating retailer.
11. Imagine Wine, LLC is not responsible for the completion or non-occurrence of the event.
12. Imagine Wine, LLC is not responsible for confirming the validity of any email vote.
13. In the event of any dispute, the decision of Imagine Wine, LLC and their representative(s) decision is final and binding on the contestant.
14. The contestants must be above 21 years of age on January 1, 2008. (Original documentation and proof of age is mandatory i.e. driver's license, passport or birth certificate.)
15. The contestant is a natural born female.
16. If the contestant wins at any particular event, the contestant may participate in future events for which they will be eligible to win again. Imagine Wine, LLC is not required to disclose to other contestants in any given event that one or more contestants participating in the current event has participated in, and or won, previous contests.
17. The contestant should be a female citizen of the United States or a female legal resident and agrees to provide proof of citizenship or legal residency if requested.
18. With her entry, the contestant will submit up to 3 photos dressed in costume as a “Pearl” look-a-like and agrees to allow Imagine Wine, LLC to post any one of those photos on their website.
19. The contestant shall wear appropriate 1940’s style clothing, make up, and hair style that resembles the Imagine Wine, LLC “Pearl” as found on many of our labels for all events and online photos. The judgment of the representative of Imagine Wine, LLC at any Tippple P Event shall be the final determinate of the appropriateness of the attire, make up, or hairstyle.
20. To qualify as a potential winner, the contestant must attend at least one Trippple P Event in costume. Additional qualifying points will be received for additional events attended.
21. Final judging will be based on independent judging by Imagine Wine, LLC judges and by votes gained at Trippple P Events and on the online.
22. Any dispute or differences arising in relation to or in connection with the search contest shall be subject to the jurisdiction of the State of California, Santa Barbara County.
23. The search contest is open to the general public. Identification must be produced on request. Partners of Imagine Wine, LLC, its retailer, advertising and promotional agencies and their respective affiliates and associates and such Partner’s immediate family members and persons with whom such Partners are domiciled are excluded from this search contest.
24. Any prize is not redeemable in cash and must be accepted as awarded.
25. By winning the search contest and accepting any prize, the winner authorizes the use, without additional compensation of his or her name and/or likeness and/or voice/photograph and municipality of residence for promotion and/or advertising purposes in any manner and in any medium (including without limitation, radio broadcasts, newspapers and other publications and in television or film releases, slides, videotape, distribution over the internet and picture data storage) which Imagine Wine, LLC may deem appropriate.
26. In accepting the prize, the winner, and any guest(s), acknowledges that Imagine Wine, LLC or its participating retailer, may not be held liable for any loss, damages or injury associated with accepting or using this prize(s).
27. Winners must sign this form below or acknowledge it’s acceptance online as prepared by Imagine Wine, LLC. acknowledging their acceptance and understanding of the complete search Rules and Regulations.
28. Imagine Wine, LLC. retains the rights, in its absolute and sole discretion, to make substitutions of equivalent kind or approximate value in the event of the unavailability of any prize or component of the prize for any reason whatsoever.
29. ARBITRATION: Any controversies or claims relating to any aspect of this search contest, or to its breach, or to the relationship created shall be settled by arbitration under the rules of the American Arbitration Association in the State of California.  The laws of the State of California, Santa Barbara County shall be deemed controlling as to all matters arising from this search contest.  The decision of the arbitrator shall be final and binding upon the parties both as to law and to fact, and shall not be appealed to any court in any jurisdiction.  The expenses of the arbitrator shall be shared equally by the parties, unless the arbitrator determines that the expenses shall be otherwise assessed. 
30. If prize involves travel, winner and travel companion must agree to the airline's Terms and Conditions of travel. Once confirmed, trip dates and travel accommodations cannot be changed by winner; however, travel is subject to availability, blackout dates, and/or change due to circumstances beyond the control of Imagine Wine, LLC. Winner and travel companion must travel on the same dates, itinerary, and fare class. No extensions will be permitted, and any unused travel will be forfeited. Prize cannot be used in conjunction with any other promotion or offer and may not be separated. All tickets issued in conjunction with the Grand Prize are not eligible for frequent flyer miles, and no code-share flights may be used.
31. This search contest is subject to all federal, state, and municipal laws.
32. Imagine Wine, LLC reserves the right to withdraw or terminate this search contest, or any scheduled event, at any time without prior notice.
33. Approximate value of prizes may vary.
